Agreement to Terms
By downloading, installing, accessing, or using the FitStreak mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and FitStreak, a Finnish company. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Description of Service
FitStreak is a fitness tracking and wellness application that helps users:
- Track workouts, exercises, sets, reps, and weights
- Monitor fitness progress, streaks, and achievements
- Set and achieve fitness and weight loss goals
- Generate personalized workout plans using artificial intelligence (AI)
- Sync health data from Health Connect (Android) or HealthKit (iOS)
- Track daily activities (steps, calories, water intake, sleep)
- View progress analytics and insights
- Receive AI-powered fitness recommendations
Eligibility
You must be at least 13 years old to use FitStreak. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.
Account Registration
Creating an Account
- You must create an account to use most features of the App
- You can sign up using email or Google authentication
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete information when creating your account
Account Security
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized access or use of your account
- You must not share your account credentials with others
- We are not liable for any loss or damage arising from unauthorized account access

1. Not Medical Advice
Informational Purpose Only: FitStreak is for informational and tracking purposes only. It is NOT a substitute for professional medical advice, diagnosis, or treatment.
2. Consult Healthcare Professionals
Always consult with a qualified healthcare provider, physician, or fitness professional before:
- Starting any fitness program
- Making significant changes to your exercise routine
- Beginning a weight loss program
- If you have any medical conditions, injuries, or health concerns
- If you are pregnant, nursing, or planning to become pregnant
- If you are taking medications that may affect your ability to exercise
- If you experience any pain, discomfort, or unusual symptoms during exercise
3. No Medical Diagnosis
The App does not provide medical diagnosis, treatment, or recommendations. Do not use the App to:
- Diagnose any health condition
- Treat any medical condition
- Replace professional medical care
- Make medical decisions
4. Individual Results
Fitness results vary by individual. The App does not guarantee:
- Specific weight loss results
- Specific fitness improvements
- Specific health outcomes
- That any workout plan will work for everyone
5. Emergency Situations
In case of a medical emergency, call your local emergency services immediately (112 in Finland and EU, 911 in the United States). Do not rely on the App for emergency medical assistance.
6. Use at Your Own Risk
You acknowledge that physical exercise and fitness activities carry inherent risks. You use the App and follow any recommendations at your own risk.
User Responsibilities
Accurate Information
- You are responsible for providing accurate and truthful information
- You must not provide false or misleading health data
- You must update your information as it changes (weight, goals, etc.)
- You are responsible for the accuracy of data you enter
Responsible Use
- Use the App responsibly and in accordance with these Terms
- Do not use the App in any way that could harm yourself or others
- Do not attempt to reverse engineer, decompile, or modify the App
- Do not use the App for any illegal purposes
- Do not interfere with or disrupt the App's operation
- Do not attempt to gain unauthorized access to the App or its systems
Compliance with Laws
- You must comply with all applicable laws and regulations
- You must not use the App in any way that violates any law
- You are responsible for ensuring your use of the App complies with local regulations
Subscription and Payments
Subscription Plans
- FitStreak offers both free and premium subscription plans
- Premium features require an active subscription
- Subscriptions are managed through RevenueCat and processed by Apple (iOS) or Google (Android)
- Subscription terms and pricing are subject to change with notice
Payment Terms
- Subscription fees are charged in advance (monthly or yearly)
- Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
- You can cancel your subscription at any time through:
- iOS: Settings > [Your Name] > Subscriptions
- Android: Google Play Store > Subscriptions
- Refunds are subject to Apple/Google policies
- We do not provide refunds except as required by law
Free Trial
- Free trials may be offered at our discretion
- Trial periods and terms are subject to change
- You will be charged if you don't cancel before the trial ends
- Only one free trial per user
Price Changes
- We reserve the right to change subscription prices
- Price changes will not affect your current subscription period
- You will be notified of price changes before your next renewal
Intellectual Property
Our Rights
- The App and all content, features, and functionality are owned by FitStreak or its licensors
- All trademarks, logos, and service marks are our property
- You may not copy, modify, distribute, or create derivative works of the App without permission
- You may not remove any copyright or proprietary notices
Your Content
- You retain ownership of data and content you create in the App
- By using the App, you grant us a license to use your data to:
- Provide and improve the service
- Generate personalized recommendations
- Operate and maintain the App
- You can delete your data at any time
- We do not claim ownership of your personal data
AI-Generated Content
- Workout plans and recommendations generated by AI are provided for your personal use
- AI-generated content may not be reproduced or distributed without permission
Limitation of Liability
No Warranties
The App is provided "AS IS" and "AS AVAILABLE". We make no warranties, expressed or implied, including:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of information
We do not guarantee:
- The App will be error-free or uninterrupted
- The App will meet your requirements
- The App will be available at all times
- That defects will be corrected
Limitation of Damages
To the maximum extent permitted by law, we are NOT liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or business opportunities
- Any injuries, health problems, or medical issues
- Any decisions made based on App data or recommendations
- Any data loss or corruption
- Any interruption of service
Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim (if any).
Health-Related Liability
We are NOT responsible for:
- Any injuries, health problems, or medical issues resulting from App use
- Any decisions made based on App data, recommendations, or AI-generated plans
- Any adverse effects from following workout plans or recommendations
- Any interactions between the App and medical conditions or medications
You use the App and follow any recommendations at your own risk. You assume all risks associated with physical exercise and fitness activities.
Indemnification
You agree to indemnify, defend, and hold harmless FitStreak, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of others
- Your violation of any applicable laws
- Any content or data you submit through the App
Account Termination
By You
- You can delete your account at any time through the App settings
- Account deletion is permanent and cannot be undone
- All your data will be deleted within 30 days
- You will lose access to all premium features immediately
- No refunds will be provided for unused subscription time
By Us
We may terminate or suspend your account immediately, without notice, if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Misuse the App or abuse our services
- Fail to pay subscription fees (for premium users)
- Use the App in a way that harms us or other users
- Provide false or misleading information
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account and data
- You will not be entitled to any refund

Prohibited Uses
You may NOT:
- Use the App for medical diagnosis or treatment
- Use the App in life-support systems or emergency services
- Reverse engineer, decompile, or disassemble the App
- Use the App for any illegal purpose
- Share your account with others
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's operation
- Use automated systems to access the App
- Copy, modify, or distribute the App without permission
- Remove any copyright or proprietary notices
Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date at the top of this document
- Sending you an email notification (for significant changes)
- Displaying a notice in the App
Your continued use of the App after changes are posted constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the App and delete your account.
Dispute Resolution
Governing Law
These Terms are governed by the laws of Finland, without regard to conflict of law principles.
Jurisdiction
Any disputes arising from or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts of Finland.
Consumer Rights (EU Users)
If you are a consumer resident in the European Union, you benefit from mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory local law.
Alternative Dispute Resolution
For EU consumers, you may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
Class Action Waiver
You agree that any disputes will be resolved individually and not as part of a class action, except where prohibited by law (e.g., for EU consumers).
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitStreak regarding the App and supersede all prior agreements.
EU Consumer Rights
If you are a consumer in the European Union, you have the right to:
- Withdraw from distance contracts within 14 days (for digital content, this right may be limited if you have consented to immediate performance)
- Receive clear information about the service
- Access out-of-court dispute resolution through the European Online Dispute Resolution platform
